TERMS OF USE AGREEMENT

Flamo Terms of Service
Welcome to Flamo, a dating app operated by Arbiella Group (FZC), officially registered in Sharjah under license number SC242050201 and located at 001-Block C VL09, Sharjah Research Technology and Innovation Park, UAE. By accessing or using Flamo’s services, you agree to be bound by this Terms of Use Agreement (“Terms”). Please read these Terms carefully before creating an account or using our services.
1. INTRODUCTION
These Terms constitute a legally binding agreement between you and Flamo. By accessing or using our services, whether via the Flamo mobile application (“App”), website, or any other platform (“Services”), you accept and agree to be bound by these Terms and our Privacy Policy, Cookie Policy, and any Additional Terms Upon Purchase, which are incorporated herein by reference.
Flamo uses advanced artificial intelligence (“AI”) to assist in matching you with other users. While our AI is designed to enhance your experience, we do not guarantee any specific outcomes, including but not limited to matches, compatibility, or relationship success.
By accessing or using our Services, you agree to:
- Comply with these Terms, as updated from time to time.
- Use the Services responsibly and lawfully.
- Acknowledge that Flamo may, at its discretion, modify or discontinue Services at any time.
2. ELIGIBILITY AND ACCOUNT RESPONSIBILITIES
Before you create an account or use Flamo, ensure that you meet all eligibility requirements outlined below. By accessing or using Flamo’s services, you represent and warrant that you satisfy all eligibility criteria and agree to fulfill the responsibilities set forth in this section.
2.1 Eligibility Criteria
2.1.a Age Requirement
You are at least 18 years old and capable of entering into a legally binding contract.
2.1.b Legal Authorization
You are not prohibited by law from using our services and are legally qualified to enter into a binding agreement with Flamo.
2.1.c Geographical Restrictions
You are not located in a country or region subject to trade restrictions, embargoes, or sanctions, including those designated as “terrorist-supporting” by any government.
2.1.d Criminal Background
You must not have been convicted of felonies or serious crimes. Exceptions for non-violent offenses may be reviewed on a case-by-case basis if you provide documentation of legal clemency or rehabilitation.
2.1.e Sex Offender Registry
You are not required to register as a sex offender under any jurisdiction.
2.1.f Account Status
You do not have more than one active account on Flamo, and you have not previously been removed, banned, or suspended from Flamo or any of its affiliates without explicit permission to create a new account.
2.1.g Account Purpose
You are using the services solely for personal, non-commercial purposes and with the intent of seeking meaningful relationships.
2.1.h Community Guidelines Compliance
You agree to abide by Flamo’s Community Guidelines and not engage in any behavior deemed inappropriate or harmful by Flamo.
2.2 User Responsibilities
2.2.a Accurate Information
You will provide truthful, accurate, and current information during the registration process and promptly update your account if any information changes.
2.2.b Respectful Conduct
You will treat other users with respect and dignity, both on and off the platform. Harassment, abuse, or offensive behavior is strictly prohibited.
2.2.c Account Security
You are solely responsible for safeguarding your login credentials and will take reasonable measures to protect the security of your account. Flamo is not responsible for unauthorized access to your account due to your negligence.
2.2.d Content Compliance
You will not upload or share any content that is offensive, harmful, or otherwise violates Flamo’s guidelines. This includes but is not limited to:
- Pornographic, violent, or hateful content.
- Misleading, defamatory, or illegal material.
- Unauthorized use of intellectual property.
2.2.e Legal Compliance
You will comply with all applicable local, national, and international laws, including but not limited to intellectual property, data privacy, and anti-spam regulations.
2.2.f Single Account Use
You will maintain only one active account and will not impersonate others or create accounts for fraudulent purposes.
3. ACCOUNT REGISTRATION AND SECURITY
Users are responsible for safeguarding their login credentials. Flamo is not liable for unauthorized access to your account due to your failure to secure your credentials. Users must notify Flamo immediately if they suspect unauthorized access.
To maintain a secure account, you must:
- Avoid sharing sensitive personal information on your profile.
- Ensure all uploaded content adheres to Flamo’s content policies.
- Use secure passwords and enable multi-factor authentication (if available).
Flamo provides secure account recovery tools, including email and phone verification. Users may be required to verify their identity to regain access to a compromised account.
4. CONDUCT AND CONTENT
4.1 User Conduct and Content Guidelines
When using Flamo, users must uphold respectful, lawful behavior and adhere to these guidelines:
- Respectful Interactions: Treat all users with dignity and avoid harassment, bullying, or offensive behavior.
- Prohibited Actions: Do not engage in misconduct such as fraud, defamation, or harm to others, and refrain from using bots, scripts, or other automated tools to misuse Flamo’s services.
- Content Standards: Users may not upload or share content that is:
- Obscene, pornographic, or violent.
- Misleading, defamatory, or illegal.
- In violation of intellectual property rights.
- Spam, irrelevant, or unsolicited advertisements.
- Reporting Violations: Use Flamo’s in-app reporting tools or contact support to report inappropriate content or behavior. Violations may result in warnings, suspension, or permanent account bans at Flamo's discretion.
4.2 Content Moderation and Reporting
Flamo reserves the right to monitor, review, and remove any content that violates these Terms or is deemed inappropriate. Violations may result in warnings, suspension, or permanent account termination.
4.2.a Reporting Mechanisms
- Users can report inappropriate behavior or content directly through Flamo’s in-app tools.
- Reports will be reviewed promptly, and necessary actions will be taken based on Flamo’s policies.
4.3 Enforcement Actions
Flamo may take the following actions against violations of these Terms:
- Temporary or permanent suspension of your account.
- Legal action where necessary to enforce these Terms or applicable laws.
By continuing to use Flamo’s services, you confirm your agreement to uphold these Conduct and Content standards.
4.4 Inappropriate Content and Misconduct; Reporting
Flamo is committed to fostering a respectful and positive community environment. Inappropriate content and misconduct, both on and off Flamo’s services, are strictly prohibited.
4.4.a Zero Tolerance for Misconduct
Flamo does not tolerate:
- Inappropriate content or behavior on the platform.
- Misconduct on services operated by Flamo’s affiliates.
4.4.b Reporting Mechanisms
If you encounter inappropriate content or misconduct, you are encouraged to report it promptly using the following methods:
- In-App Reporting Tools: Use the “Report User” link available on a user’s profile or within the messaging experience.
- Customer Support Contact: Reach out to Flamo’s Customer Support team for assistance.
4.4.c Actions Against Violations
To maintain user safety and uphold community standards, Flamo may take the following actions against users who violate these Terms:
- Account Ban: Permanently banning the user from accessing Flamo’s services and affiliates’ platforms.
- Account Restrictions: Restricting the creation of new accounts.
- Affiliate Data Sharing: Sharing necessary data among Flamo’s affiliates for safety and security purposes, in line with our Privacy Policy.
4.4.d Safety-Driven Privacy Limitations
In situations where sharing information about account actions might compromise the safety or privacy of other users, Flamo reserves the right to withhold details regarding enforcement measures taken against reported users.
4.4.e Intellectual Property Infringement Reporting
In compliance with applicable laws, including the Digital Millennium Copyright Act (DMCA), Flamo provides mechanisms for reporting Member Content that may infringe upon intellectual property rights. To file a complaint, refer to Section 12.
By participating in Flamo’s community, you agree to uphold these standards and report violations to support a safe and positive experience for all users.
5. PRIVACY
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal data.
Flamo complies with applicable data protection regulations, including GDPR and CCPA. Users can request data deletion or access transparency reports about their data upon request.
Flamo employs:
- End-to-end encryption for messages.
- Multi-factor authentication for account protection.

6. RIGHTS
6.1 Rights You Are Granted by Flamo
Flamo grants you the right to use and enjoy our Services, subject to these Terms.
For as long as you comply with these Terms, Flamo grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use our Services for purposes intended by Flamo and permitted by these Terms and applicable laws.
This license and any authorization to access the Services are automatically revoked if you fail to comply with these Terms.
6.2 Rights You Grant Flamo
You own all of the content you provide to Flamo, but you also grant us the right to use Your Content as provided in this Agreement.
By creating an account, you grant Flamo a worldwide, perpetual, transferable, sub-licensable, royalty-free right and license to:
- Host, store, use, copy, display, reproduce, adapt, edit, publish, translate, modify, reformat, incorporate into other works, advertise, distribute, and otherwise make available Your Content, including any information you authorize us to access from third-party sources, in any format or medium.
- Prevent the use of Your Content outside of our Services and act on your behalf with respect to infringing uses of Your Content by other users or third parties.
Flamo's license to Your Content is subject to your rights under applicable law (e.g., personal data protection laws).
In consideration for Flamo allowing you to use our Services, you agree that we, our affiliates, and third-party partners may place advertising on our Services.
By submitting suggestions or feedback to Flamo, you agree that Flamo may use and share such feedback for any purpose without compensating you.
You agree that Flamo may access, preserve, and disclose your account information, including Your Content, if required to:
- Comply with legal processes.
- Enforce these Terms.
- Respond to claims of violations of rights.
- Protect the rights or safety of Flamo or others.
7. PAYMENT TERMS
Flamo allows users to access free features and purchase Flamo Coins, a virtual currency used to unlock various offerings within the platform. The following outlines the terms applicable to purchasing and using Flamo Coins:
7.1 Payment Options
Flamo offers multiple payment methods to ensure user convenience, including:
- Credit card payments.
- PayPal transactions.
- In-app purchases via the Apple App Store or Google Play.
When you purchase Flamo Coins, the transaction details, including the price and applicable taxes, will be disclosed before you complete your purchase. All transactions are subject to the terms of the respective payment processors.
7.2 Purchasing Flamo Coins
- Non-Refundable: Purchases of Flamo Coins are final and non-refundable, except as required by law.
- Personal License: Flamo Coins grant you a limited, non-transferable, non-sublicensable, revocable license to access and use virtual items or features within the platform. Flamo Coins hold no real-world monetary value and cannot be exchanged for cash or other forms of payment outside the platform.
- Expiration and Usage: Flamo Coins do not expire, but their usage is subject to these Terms. Flamo reserves the right to modify or discontinue features associated with Flamo Coins at any time.
7.3 Price Adjustments and Promotions
Flamo may offer promotions, discounts, or pricing adjustments. These offers are subject to specific terms and may vary based on:
- Geographic region.
- Number of Flamo Coins purchased.
- Promotional periods or campaigns.
In the event of a price change for Flamo Coins, Flamo will make reasonable efforts to notify you in advance. Continued use of the Services after a price change constitutes acceptance of the updated pricing.
7.4 Unauthorized Transactions
You are responsible for safeguarding your account credentials to prevent unauthorized purchases. Flamo is not liable for unauthorized transactions made through your account. Should you suspect unauthorized activity, contact Flamo Support immediately.
7.5 Virtual Items Policy
- Final Sale: All purchases of Flamo Coins and virtual items are final and non-refundable.
- Restrictions: Flamo Coins and virtual items may not be transferred, sold, or exchanged outside the platform. Any attempt to do so may result in the suspension or termination of your account.
- Modifications: Flamo reserves the right to manage, regulate, or modify Flamo Coins and virtual items at its discretion. This includes adjusting their availability, perceived value, or features without liability to users.
7.6 Disputes and Chargebacks
If you dispute a transaction or initiate a chargeback with your payment provider, Flamo reserves the right to:
- Suspend or terminate your account.
- Retain any Flamo Coins or virtual items purchased until the dispute is resolved.
For assistance with transaction issues, contact Flamo Support before initiating a chargeback.
7.7 Taxes
Depending on your location, taxes may apply to your purchases. Any applicable taxes will be disclosed at the time of purchase. You are responsible for paying any such taxes.
7.8 Compliance with Platform Rules
Flamo Coins must be used in accordance with these Terms and any additional rules governing specific features. Misuse of Flamo Coins or associated features may result in account penalties, including suspension or termination.
By purchasing Flamo Coins, you acknowledge that you have read, understood, and agreed to these Payment Terms.
8. AUTOMATIC RENEWALS
Flamo may offer subscription-based services to enhance your experience with additional features and benefits. The following terms apply to all subscription models:
8.1 Automatic Renewal Policy
- Subscriptions automatically renew at the end of each subscription period unless canceled before the renewal date.
- Your chosen payment method will be charged the applicable subscription fee at the start of each renewal period.
8.2 Notification of Renewal
Flamo provides reasonable advance notice before the renewal of a subscription, detailing the upcoming charge, including the amount and renewal period.
It is your responsibility to monitor renewal notifications and cancel subscriptions if desired.
8.3 Cancellation Policy
- You can cancel your subscription anytime through your account settings or the payment platform used for the purchase (e.g., Apple App Store or Google Play).
- Cancellation takes effect at the end of the current subscription period, allowing you to retain access to subscription benefits until then.
- No refunds will be issued for partial subscription periods unless required by applicable law.
8.4 Price Adjustments
Flamo reserves the right to adjust subscription prices. Users will be notified in advance of any price changes, and subscriptions will not renew at the new price without prior acknowledgment.
8.5 Compliance with Payment Terms
All subscriptions are subject to the Payment Terms outlined in Section 7. Misuse or unauthorized activity related to subscriptions may result in the suspension or termination of your account.
By using Flamo's subscription services, you acknowledge and agree to these terms, ensuring a seamless and transparent experience for all users.
9. CANCELLATION AND REFUNDS
9.1 General Refund Policy
- All purchases made within Flamo, including Flamo Coins, are final and non-refundable, except as required by applicable law.
- Refunds or credits for partially used periods are not provided unless mandated by specific jurisdictional laws.
9.2 Flamo Coins Policy
- Flamo Coins can only be purchased directly through the Flamo app or website.
- Flamo Coins are non-refundable, non-transferable, and may only be used within the Flamo platform.
- Any unused Flamo Coins will expire if your account is terminated, either voluntarily or involuntarily, as outlined in the Terms of Service.
9.3 Jurisdiction-Specific Refund Rights
EU, EEA, UK, and Switzerland Residents:
- Users are entitled to a full refund if the cancellation request is made within 14 days of the purchase date, in compliance with local consumer protection laws.
Germany Residents:
- Users may cancel subscriptions after automatic renewal with a one-month notice period.
Residents of Arizona, California, Colorado, and Other Specified Jurisdictions:
- Users may cancel purchases within three business days following the purchase date.
- In cases of death or disability, refunds may be provided for unused portions of purchases.
9.4 Refunds and Cancellations
- Refund Eligibility: Purchases made on Flamo are generally non-refundable, except as required by applicable law or under the following circumstances:
- Residents of jurisdictions with specific refund laws may request refunds within the specified legal timeframe.
- Cancellation of Subscriptions: Subscriptions can be canceled at any time through account settings. Cancellation will take effect at the end of the billing period, and no partial refunds will be provided.
- Refund Process: For eligible refunds, contact Flamo Support with proof of purchase and account details.
- Unused Virtual Currency: Flamo Coins are non-transferable and non-refundable, even upon account cancellation or termination.
9.5 Additional Terms
Flamo reserves the right to update or modify its refund and cancellation policies to comply with applicable laws. Changes will be communicated via updates to the Terms of Service or user notifications.
10. ACCOUNT TERMINATION
10.1 User-Initiated Termination
You may delete your account at any time by:
- Logging into the Flamo App or Website.
- Navigating to the Settings section.
- Clicking on Delete Account and following the prompts to complete the process.
Important: Deleting your account does not automatically cancel any external purchases (e.g., through Apple or Google). You must manage or cancel these directly with the external service provider to avoid further billing.
10.2 Flamo-Initiated Termination
Flamo reserves the right to investigate and, if necessary, suspend or terminate your account without notice or refund if:
- You violate these Terms.
- You misuse our Services or behave in a manner deemed inappropriate, harmful, or unlawful, on or off the platform.
- Your actions negatively impact the safety, rights, or experience of other users or the integrity of the platform.
Flamo may utilize personal, technological, or legal measures to enforce these Terms and prevent future access to its Services.
10.3 Effect of Termination
Upon account termination, whether initiated by you or by Flamo:
- These Terms will continue to remain enforceable between you and Flamo.
- You will not be entitled to any refund for Flamo Coins or other purchases.
- Access to your account and its contents will be permanently revoked.
- Your personal information will be handled according to Flamo's Privacy Policy, which outlines data retention and deletion practices.
10.4 Appeals and Inquiries
If your account is terminated and you believe it was in error, you may contact Flamo Support for review via the in-app help center or customer service email. Flamo’s decision on account reinstatement, if applicable, will be final.
11. NO CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS
11.1 No Background or Identity Checks Conducted
- Flamo does not conduct criminal background or identity verification checks on its users.
- While Flamo strives to foster a safe and respectful user experience, it is not responsible for the conduct of any user on or off the platform.
11.2 User Responsibility
Users acknowledge that Flamo does not verify the background, criminal history, identity, intentions, health, or physical condition of its users. Flamo makes no representations or warranties about the legitimacy, safety, or accuracy of user-provided information. Users are solely responsible for their interactions with others on or off the platform and must exercise caution and judgment in communications and meetings.
11.3 Flamo’s Rights
Flamo reserves the right to conduct criminal background checks or other screenings (e.g., sex offender registry searches) at any time using publicly available records. By using Flamo, users grant permission for their provided information to be used in such screenings if deemed necessary.
11.4 Safety Recommendations
Users are encouraged to review Flamo’s Safety Guidelines and adhere to best practices for personal safety when interacting with others. Communications received through the platform may result from improper activities such as fraud, abuse, or harassment. Flamo is not liable for such activities. Users should exercise caution, especially when deciding to communicate outside the platform or meet in person.
12. COPYRIGHT COMPLIANCE
Flamo is committed to respecting intellectual property rights and adheres to copyright protection laws, including provisions similar to the Digital Millennium Copyright Act (DMCA). If you believe any content on Flamo infringes your intellectual property rights, you may submit a Takedown Notice as outlined below.
12.1 Filing a Takedown Notice
To file a Takedown Notice, include the following details in your request:
- A physical or electronic signature of the individual authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Specific identification of the allegedly infringing material, including information sufficient to help Flamo locate it on the platform (e.g., direct links or descriptions).
- Contact details, such as your address, phone number, and email, to allow Flamo to reach you.
- A statement affirming your good faith belief that the use of the material is unauthorized by the copyright owner, its agent, or applicable law.
- A statement made under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

12.2 Counter-Notice
If you believe that content was removed or disabled by mistake, you may file a Counter-Notice containing:
- Sufficient details to identify the removed material and its original location.
- A statement under penalty of perjury that the content was removed in error or was misidentified.
- Your consent to the jurisdiction of the relevant court and agreement to accept service of process from the complainant, if required.
Upon receiving a valid Counter-Notice, Flamo may restore the content unless the complainant initiates legal proceedings within the prescribed time frame.
12.3 Limitations
Flamo’s actions regarding takedown requests do not constitute legal advice or a determination on the validity of the claim. Users are encouraged to seek legal guidance for detailed advice regarding their intellectual property rights. Misuse of this process may result in legal consequences.
13. DISCLAIMERS
13.1 General Disclaimer
Flamo provides its services on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Flamo makes no warranties of any kind, whether express, implied, statutory, or otherwise, regarding the Services. This includes, but is not limited to, implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement. Flamo does not guarantee uninterrupted, secure, or error-free operation of the Services, the correction of defects or errors, or the accuracy, completeness, currency, or reliability of any content or information provided through the Services.
13.2 User Interactions and Content
Flamo makes no guarantees regarding the number of active users at any given time, the desire or ability of users to communicate with or meet you, or the compatibility, intent, or conduct of users you may interact with through the Services. Users acknowledge that all interactions with other users are undertaken at their own discretion and risk. Flamo assumes no responsibility for content posted, sent, or received by any user or third party through the Services, or for the identity, intentions, legitimacy, or accuracy of information provided by any user.
13.3 Risks and Responsibilities
Any material downloaded or otherwise obtained through the Services is accessed at the user’s own discretion and risk. Flamo is not responsible for any damage or loss arising from the use of its Services, including but not limited to security breaches, viruses, bugs, tampering, hacking, fraud, errors, or interruptions, delays, or other technical malfunctions of the Services or related systems.
13.4 Limitations
Flamo does not guarantee that its Services will meet your expectations or be suitable for your specific purpose. Users are encouraged to exercise caution and utilize their best judgment when using the Services and interacting with others. By using Flamo’s Services, you agree that you fully understand and accept the inherent risks involved, and that Flamo is not liable for any consequences arising from your use of the platform.
14. LIMITATION OF LIABILITY
14.1 General Limitation
To the fullest extent permitted by applicable law, Flamo, its affiliates, employees, licensors, or service providers shall not be liable for any indirect, incidental, consequential, special, punitive, fixed, or enhanced damages, including, without limitation:
- Loss of profits (whether incurred directly or indirectly).
- Loss of data, use, goodwill, or other intangible losses.
- Any unauthorized access, use, or alteration of your content.
- Damages resulting from your inability to access or use the Services, or from any conduct or content of other users or third parties through the Services.
This limitation applies even if Flamo has been advised of the possibility of such damages.
14.2 Maximum Liability
To the extent permitted by applicable law, Flamo’s total aggregate liability to you for all claims arising out of or related to the Services, this Agreement, or your use thereof shall not exceed the greater of:
- $100 USD, or
- The amount paid by you to Flamo for the Services in the 12 months immediately preceding the claim.
This limitation applies regardless of:
- The basis on which liability is asserted (contract, tort, statute, or otherwise).
- The type of breach of rights, privileges, or obligations.
- The number or nature of claims made.
14.3 Jurisdictional Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, the limitations set forth in this section may not apply to you to the extent prohibited by applicable law.
14.4 Essential Purpose
The limitation of liability provisions in this section shall apply even if the remedies under this Agreement fail to meet their essential purpose. By using Flamo’s Services, you expressly agree to this limitation of liability.
15. INDEMNITY
15.1 Your Agreement to Indemnify Flamo
You agree to indemnify, defend, and hold harmless Flamo, its affiliates, subsidiaries, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your Use of the Services: Any activity you engage in on or through Flamo’s Services or violations of this Agreement, Community Guidelines, or any applicable law.
- Content You Provide: Any content you upload, share, or otherwise make available through the Services, including claims that your content infringes upon the intellectual property or privacy rights of any third party.
- Your Interactions with Other Users: Any disputes or claims arising from your interactions with other users, including but not limited to claims of misconduct, defamation, or harassment.
- Unlawful or Improper Use: Any improper, unauthorized, or illegal use of the Services by you or anyone accessing your account with or without your permission.
15.2 Indemnification Process
Flamo will provide notice of any claim or demand subject to indemnification. You agree to cooperate fully in the defense of any such claim or demand, at your expense. Flamo reserves the right to assume the exclusive defense and control of any matter subject to indemnification, at your expense, if Flamo determines in its sole discretion that you are not adequately protecting Flamo’s interests.
15.3 Limitations
This indemnity obligation will not apply to the extent that any claims, demands, or damages arise solely from Flamo’s gross negligence or intentional misconduct.
By agreeing to these Terms, you accept the indemnification obligations outlined above. These obligations will survive the termination of your account or your use of Flamo’s Services.
16. MODIFICATIONS TO SERVICES AND TERMS
16.1 Right to Modify Services
Flamo reserves the right to modify, suspend, or discontinue any aspect of its Services at any time, with or without prior notice. This includes, but is not limited to, adding new features, removing existing functionalities, or changing the availability of the Services.
16.2 Right to Amend Terms
Flamo may amend these Terms periodically to reflect updates to our Services, changes in policies, or legal requirements. Any amendments will be posted on our platform, with the "Effective Date" of the revised Terms clearly indicated.
16.3 User Notification
Where legally required, users will be notified of material changes to these Terms through email or in-app notifications.
16.4 User Acceptance
By continuing to access or use Flamo’s Services after the updated Terms take effect, you acknowledge and agree to the revised Terms. If you do not agree with the modifications, you must discontinue using the Services and delete your account.
17. GOVERNING LAW
17.1 Applicable Law
These Terms, and any disputes arising out of or relating to them or the Services, shall be governed by and construed in accordance with the laws of Sharjah, UAE, excluding its conflict of laws principles.
17.2 Exclusive Jurisdiction
Any legal disputes or claims related to these Terms or Flamo’s Services shall be exclusively brought before the courts of Sharjah, UAE.
17.3 Compliance with Local Laws
Users accessing Flamo from outside of Sharjah, UAE, are responsible for ensuring that their use of the Services complies with all applicable local laws and regulations.
This section applies to the fullest extent permitted by law. If any provision of this section is deemed invalid or unenforceable, the remaining provisions shall remain in full effect.
18. DISPUTE RESOLUTION
18.1 Informal Dispute Resolution
Flamo is committed to fostering a positive relationship with its users and aims to resolve disputes efficiently and amicably. If you have any disagreement, claim, or concern ("Dispute") regarding this Agreement, the Services, or your relationship with Flamo, you agree to attempt to resolve the issue informally before pursuing further action. A "Dispute" includes any disagreement, claim, or controversy arising from or relating to this Agreement, the Services, or your relationship with Flamo, including claims that arose before the existence of this Agreement or after its termination. To initiate the informal dispute resolution process, you must send a detailed written notice ("Notice") to Flamo Customer Support, including your full name and contact information, a detailed description of the Dispute with the nature of your claims and the relief you seek, and any relevant supporting documentation. Flamo will send its Notice to the contact information associated with your account. You and Flamo agree to negotiate in good faith to resolve the Dispute within 60 days of Flamo's receipt of your Notice. If the Dispute is not resolved within this time, either party may proceed with arbitration or small claims court as outlined below.
18.2 Arbitration Agreement
Agreement to Arbitrate
Except where prohibited by law, you and Flamo agree to resolve all Disputes exclusively through binding individual arbitration, waiving the right to a trial by jury or to participate in class action or representative lawsuits.
Arbitration Process
Arbitration will be conducted by a neutral arbitrator in accordance with the rules of a mutually agreed arbitration provider. If the parties cannot agree on an arbitration provider, one will be appointed by a court of competent jurisdiction. Arbitration will take place in a mutually agreed-upon location or virtually if both parties consent. The arbitrator will have exclusive authority to resolve disputes relating to the interpretation, applicability, enforceability, or formation of this Agreement, including claims that all or part of this Agreement is void or voidable.
Costs
Each party will bear its own legal fees and costs associated with arbitration unless otherwise determined by the arbitrator under applicable law.
Exceptions to Arbitration
Either party may elect to bring individual claims in small claims court instead of arbitration, provided the claims are eligible under the jurisdiction of the small claims court.
18.3 Class Action and Jury Trial Waiver
To the fullest extent permitted by law, you and Flamo agree to resolve Disputes on an individual basis and not participate in any class, collective, or representative proceedings. Both parties waive the right to a jury trial for any Dispute. If a court finds that the class action waiver is unenforceable, this entire arbitration section (except for the informal dispute resolution process) will be null and void, and the Dispute will proceed in court.
18.4 Governing Law and Venue
This Agreement and any Disputes shall be governed by the laws of Sharjah, UAE, excluding its conflict of law principles. Arbitration proceedings or permissible court actions will take place in Sharjah, UAE, unless otherwise required by applicable law.
18.5 Severability
If any portion of this Dispute Resolution section is found to be unenforceable, the remainder will remain in effect unless otherwise specified in 18.3 Class Action and Jury Trial Waiver.
By accessing and using Flamo’s Services, you expressly agree to the terms outlined in this Dispute Resolution section.
19. ENTIRE AGREEMENT
This Agreement supersedes any previous agreements or representations. These Terms, along with the Privacy Policy, Cookie Policy, Community Guidelines, Safety Tips, and any Additional Terms Upon Purchase, constitute the entire agreement between you and Flamo regarding the use of our Services. This Agreement replaces all prior agreements, representations, or arrangements, whether written or oral, between you and Flamo.
If any provision of these Terms is found to be invalid, illegal, or otherwise unenforceable, the remaining provisions shall continue in full force and effect. Failure by Flamo to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
Your Flamo account is non-transferable, and all rights to your account and its content terminate upon your death unless otherwise provided by law. Any rights or licenses granted under these Terms may not be transferred or assigned by you, but may be assigned by Flamo without restriction. This Agreement does not create an agency, partnership, joint venture, fiduciary, or other special relationship between you and Flamo, and you agree that you may not make representations on behalf of or bind Flamo in any manner.
